1. About these terms

By requesting a quotation, creating an account, or placing an order, you agree to these terms.

2. Our service

Total Custom Patches provides custom-manufactured embroidered patches on a quotation basis. The website is not an online shop: we do not display public pricing, and there is no direct checkout. Every project begins with a quotation request and is manually reviewed before production.

3. Quotations

Quotations are prepared individually based on your requirements (size, quantity, colors, backing, border, and other specifications). A quotation is an estimate for your consideration and does not create a binding order until you approve it and we confirm acceptance. Quotations may be valid for a limited period stated in the quotation.

4. Orders, proofs & approvals

Our process includes approval stages designed to protect you:

We professionally review your artwork and prepare a digital proof.
You approve the digital proof or request revisions.
We issue an invoice; payment is required before production of a sample.
We manufacture a production sample and share photographs for your approval.
Production begins only after you approve the production sample.

You are responsible for carefully reviewing proofs and samples. Once you approve a proof or sample, it represents your confirmation of the design, spelling, colors, and specifications shown.

5. Artwork & intellectual property

You confirm that you own, or are authorized to use, all logos, designs, text, trademarks, and other materials in the artwork you submit, and that our production of them will not infringe any third party’s rights.
You grant us the license necessary to review, digitize, reproduce, and manufacture your artwork for the purpose of fulfilling your order.
You agree to indemnify us against claims arising from artwork you supply.
Ownership of digitized embroidery files and production tooling is as described in your quotation or {{IP_TERMS_REFERENCE}} — to be confirmed by counsel.

6. Pricing, payment & taxes

Prices are provided in your quotation. Payment is processed securely through our payment provider (2Checkout / Verifone). Unless stated otherwise, prices exclude applicable taxes, customs duties, and import fees, which may be your responsibility (see the Shipping Policy).

7. Production times

Any production or turnaround times we provide are good-faith estimates that begin after required approvals and payment are complete. They are not guarantees, and timelines may be affected by artwork complexity, revisions, quantity, and factors outside our control.

8. Shipping & risk

We ship via DHL or FedEx and provide tracking. Delivery timelines are estimates. Responsibility for customs duties/taxes on international shipments, address accuracy, and related matters is described in the Shipping Policy.

9. Cancellations, changes & refunds

Because patches are custom-manufactured to your approved specifications, cancellation and refund rights are limited once production has begun. Please see the Refund & Returns Policy for full details, including how we handle manufacturing defects or items that do not match the approved proof or sample.

10. Quality & remedies

We manufacture with precision and inspect orders before shipment. If an item has a genuine manufacturing defect or does not match what you approved, contact us promptly and we will work with you on an appropriate remedy as set out in the Refund & Returns Policy.

11. Limitation of liability

To the maximum extent permitted by law, our total liability arising from an order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses. Nothing in these terms excludes liability that cannot lawfully be excluded. (Scope to be confirmed by counsel.)

12. Accounts

You are responsible for keeping your account credentials secure and for activity under your account. Notify us promptly of any unauthorized use.

13. Governing law

14. Changes to these terms
